Logements de fonction : un premier pas vers la transparence

FlickR - PARIS, L'hôtel Le Brun (XVIIIème siècle) - fredpanassacAprès l’« affaire Martinez » en référence au logement de fonction de l’ex-directeur général du CHU de Caen et de sa décision d’entreprendre des travaux pour la modique somme de 800.000 euros, sans évoquer ceux effectués dans les appartements de quelques-uns de ses collaborateurs, la nécessité se faisait pressante pour les pouvoirs publics de publier un décret qui patientait dans les tiroirs depuis 1986, date de publication de la loi portant statut de la fonction publique hospitalière. Le décret est finalement paru le 10 janvier dernier. Il s’agit du décret n°2010-30 du 8 janvier 2010, lequel ne comporte rien de révolutionnaire mais constitue assurément un premier pas vers la transparence.

On y retrouve bien entendu la classique distinction entre la nécessité absolue de service et l’utilité de service, dans le cadre de la concession de logements de fonction.

Par principe, les DH ((Directeurs d’hôpital.)) et les D3S ((Directeurs des établissements sanitaires, sociaux et médico-sociaux.)), comme on dit dans le jargon, bénéficient d’un logement par nécessité absolue de service. Certains corps de catégorie A limitativement énumérés, tels les directeurs des soins, les ingénieurs, les cadres socio-éducatifs, les cadres de santé, les attachés d’administration hospitalière et enfin les responsables des centres maternels, de pouponnières et de crèche, bénéficient également du dispositif sous réserve d’assurer un nombre annuel minimum de 40 journées de gardes de direction.

Ces logements se situent par priorité dans le patrimoine de l’établissement. A défaut, soit un logement locatif est mis à la disposition des personnels considérés, soit une indemnité compensatrice mensuelle leur est allouée. Ces deux options supposent par ailleurs que la localisation desdits logements soit compatible avec la mise en oeuvre de gardes de direction. Les fonctionnaires bénéficiaires ne peuvent prétendre à la rémunération d’heures supplémentaire ssous forme d’indemnités horaires ou forfaitaires.

Lorsqu’ils sont placés en situation de recherche d’affectation, les DH et les D3S conservent, sur leur demande et sur décision du directeur général du CNG ((Centre national de gestion des personnels de direction et des praticiens hospitaliers.)), le bénéfice du logement aussi longtemps qu’ils n’ont pas reçu une nouvelle affectation.

S’agissant de deux conjoints, deux pacsés ou deux concubins dans le corps des DH et des D3S (si l’on peut dire), le cumul n’est possible qu’à condition qu’un « éloignement [serait] tel qu’un domicile commun ferait obstacle à la mise en oeuvre de gardes de direction ».

Certaines dispositions communes méritent d’être relevées. Précaires et révocables, les concessions de logement sont attachées à la période d’occupation de l’emploi qui les justifie. Les fonctionnaires concernés sont soumis aux dispositions de l’article 82 du code général des impôts et aux dispositions des articles L.242-1 et R.242-1 du code de la sécurité sociale.

L’article 13 fait directement écho à l’« affaire Martinez » :

« Les dépenses d’investissement et de gros entretien afférentes aux logements concédés dans le patrimoine de l’établissement figurent au programme annuel de travaux de l’établissement. Le bilan d’exécution de ces dépenses ainsi que des dépenses d’entretien courant fait l’objet d’une présentation annuelle auprès de l’assemblée délibérante de l’établissement ».

L’absence des fonctionnaires intéressés au titre de l’utilisation des jours accumulés sur leur compte épargne-temps ne les pénalise pas et leur permet de conserver, à leur demande, le bénéfice des concessions de logement pour nécessité absolue de service ou pour utilité de service.

Afin de ne pas bousculer les situations irrégulières en cours, le décret a prévu des dispositions transitoires permettant un statu quo pendant deux ans maximum à compter de sa publication.

D’un point de vue critique, le décret :

  • confirme que les directeurs des soins ne sont pas traités comme les DH ou les D3S,
  • impose un nombre élevé de gardes pour les cadres A, à l’exclusion des DH et des D3S,
  • apporte une définition relativement floue (ou souple, c’est selon) des conditions de logement extérieur à l’établissement,
  • observe un certain mutisme sur la position des directeurs mis à disposition.

The question is whether MLS will let him out of his contract/sell him for a reasonable fee. It’ll be a good test of whether MLS truly cares about their players or just about their own success.
