Considérant qu’aux termes de l’article 8 du décret du 29 avril 1971 relatif aux fonctions et au régime indemnitaire des fonctionnaires de l’Etat et des établissements publics affectés au traitement de l’information : La prime de fonctions, essentiellement variable et personnelle, est allouée compte tenu de la valeur professionnelle et de l’activité de chacun des fonctionnaires et agents susceptibles d’en bénéficier (…) ; que le bénéfice de la prime de fonctions à laquelle peuvent prétendre les fonctionnaires et agents de l’Etat affectés au traitement de l’information est, compte tenu des critères prévus pour son attribution, lié à l’exercice effectif des fonctions ; que, dès lors, en jugeant que cette prime constitue un complément de traitement au sens des dispositions précitées de l’article 77 de la loi du 9 janvier 1986, le tribunal administratif de Paris a commis une erreur de droit ; que l’ASSISTANCE PUBLIQUE-HOPITAUX DE PARIS est par suite fondée à demander l’annulation du jugement du 22 janvier 2009 par lequel le tribunal a annulé la décision de la directrice générale refusant à M.
